Tahir Ibrahim, counsel to the former Managing Director of the Kano Agricultural Supply Company, Bala Mohammed, has accused the Kano State Public Complaints and Anti-Corruption Commission of disregarding court orders.
Ibrahim called on the Commission’s Chairman, Muhuyi Rimin-Gado, to comply with a court directive vacating an order that allegedly authorised the confiscation of his client’s properties.
The controversy arises amid the PCACC’s investigation into allegations of financial mismanagement against Mohammed.
Addressing journalists on Friday evening, the lawyer criticised the anti-graft agency’s actions.
“We are asking Muhuyi to allow the court officials to do their work and comply with the court order that already vacated the order he claims he has a right to attach Bala Inuwa’s property,” Ibrahim said.
He further alleged that Rimin-Gado was undermining the judicial process.
“He (Muhuyi) does not have that right to confiscate Mohammed’s properties. He should comply with the first court order and the court order that gave police the order to vacate the place.
“It’s an abuse of court process by Muhuyi to ignore the court order which directed that all his bank accounts be unfrozen, police should leave his company, Limestone Processing Company, and pay the N3 million fine as damages.
“We are also asking the police to comply because nobody is above the law. We are all living peacefully because of the rule of law. Where there is no rule of law, there will be no peace,” he added.
Ibrahim also dismissed the PCACC Chairman’s authority to summon him.
“Muhuyi cannot do anything out of his jurisdiction,” he asserted.
However, in his response, Rimin-Gado alleged that the lawyer and a police officer conspired to fraudulently obtain a court order to recover confiscated properties amid an ongoing investigation into alleged misappropriation of N4 billion by the former KASCO Managing Director.
“The lawyer connived with one police officer and obtained the said court order to also obstruct the ongoing investigation,” Rimin-Gado claimed.
He further denied any knowledge of the court order.
“We are not aware of the order. I will not comply with a court order which we are not a party to,” the PCACC Chairman stated.
