Judge orders Trump to give Venezuelan migrants 21 days’ notice before deportations

A US federal judge in Colorado on Tuesday ordered President Donald Trump to give Venezuelan migrants arrested in the state 21 days’ notice before any deportations, under a law historically used only in wartime.

This is to inform the migrants of their right to challenge their removal.

US District Judge Charlotte Sweeney, in a written ruling maintaining a temporary block within Colorado on deportations under the 1798 Alien Enemies Act, said the administration must inform the migrants, in a language they understand, of their right to consult a lawyer.

At a court hearing on Monday, Sweeney had expressed scepticism that the 24 hours’ notice the Trump administration had pledged to give would satisfy the US Supreme Court’s earlier order requiring migrants to be allowed to challenge their removals in court.

The Justice Department did not immediately comment at the time of filing this report.
