The Courtroom of Attraction, Ibadan Division, on Tuesday fastened Feb. 8 for listening to of an enchantment filed by a former Oyo State Deputy Governor, Mr Rauf Olaniyan, difficult his impeachment by the Home of Meeting.
The Information Company of Nigeria (NAN) studies that the primary and second respondents within the enchantment are: Oyo State Home of Meeting and Clerk, with the Chief Justice of Oyo State, the Lawyer-Basic and Kayode Christopher because the third to fifth respondents.
The enchantment panel chaired by Justice Yargata Nimpa fastened Feb. 8 for listening to after granting the appliance for extension of time of transient of argument filed by counsel to the primary and second respondents, Mr Samuel Oyadoyin.
The panel additionally granted the movement of the appellant’s counsel, Mr Kazeem Gbadamosi, SAN, to deem the appellant’s reply transient of Nov. 23, 2023 as correctly filed earlier than the courtroom.
The panel, earlier than granting the appliance and movement, had requested the counsel to the third and fifth respondents, Mr O.A. Ogunniran, Director of Litigation within the state Ministry of Justice, whether or not he was against it, to which he stated ‘No’.
“The applying for extension of time to file transient of argument of first and second respondents and the movement of the applicant is granted.
“The case is adjourned to Feb. 8 for listening to,” Nimpa stated.
NAN recollects that Justice Bayo Taiwo of Oyo State Excessive Courtroom had, in his judgment on Jan. 9, 2023, declared as constitutional, the method of Olaniyan’s impeachment by the meeting and, consequently, upheld the impeachment.
Not glad with the judgment, Olaniyan had approached the appellate courtroom, praying it to set it apart and nullify his impeachment for not complying with constitutional provisions and thus missing truthful listening to.
NAN studies that the previous deputy governor was impeached by the meeting over allegations of economic recklessness, misconduct and insubordination, amongst others.
