Justice Nkeonye Evelyn Maha of the Federal High Court, Ibadan, Oyo State, has fixed October 26, 2026, for judgment in a suit filed by Mr Wakil Oyeleru Oyedemi on the primary election conducted by the All Progressives Congress (APC) for Afijio/Atiba/Oyo East/Oyo West Federal Constituency.
In the suit with Number FHC/IB/CS/64/2026, Wakil Oyeleru Oyedemi prayed the court to annul the result of the primary election in the four local government areas of the Federal Constituency due to alleged irregularities and non-compliance with guidelines, and order another primary election.
The parties in the matter, at a hearing on Monday, addressed the court and adopted their written addresses on the matter.
Wakil Oyedemi, through his counsel, Musibau Adetunbi (SAN), had sued the APC and joined Hon Akeem Adeyemi and the Independent National Electoral Commission (INEC) as second and third defendants respectively.
Oyedemi had argued through his counsel (Adetunbi) that the INEC, the body monitoring the primary election itself, had allegedly admitted that accreditation of members (of the APC) was not conducted in Afijio, Atiba, Oyo East and Oyo West – the four local government areas that make up the federal constituency.
He said based on this and other evidence which he said had been presented before the court, his client “is seeking the annulment of the purported primary election and order another one.”

In his submission, counsel for the first defendant (APC), Ibrahim Bawa (SAN), urged the court to dismiss Oyedemi’s application, saying the individuals who were called as witnesses by the plaintiff/respondent were not qualified to be as the matter was a special procedure.
Also asking the court to dismiss Oyedemi’s suit, counsel for Hon Adeyemi, Kazeem Adedeji, said the reliefs sought by Oyedemi were declaratory in nature, and were trite.
He said notices of preliminary objection had been filed against the plaintiff’s applications.
Counsel for INEC, A. F. Lawal, while also addressing the court, listed the affidavits his clients had filed in their objection to the reliefs sought by the plaintiffs.
Lawal said INEC aligned itself with the submissions of the first defendant on the matter.
Wakil Oyeleru Oyedemi had filed the suit to reject the conduct of the APC National Assembly primary election, conducted in May this year, for Afijio/Atiba/Oyo East/Oyo West Federal Constituency, citing irregularities.
He asked the court to annul the primary, which APC said was won by the member currently representing the federal constituency in the House of Representatives, Hon Akeem Adeyemi, and conduct another one.
